Free Digital Education Disclaimer
Important terms, conditions and limitations governing access to educational resources, digital learning activities and related services offered by NSAR Foundation.
01Purpose and Scope
NSAR Foundation (hereinafter referred to as the “Foundation”) undertakes educational and community-oriented initiatives intended to promote digital literacy, educational access, technology awareness and learning opportunities. The Free Digital Education initiative may include digital learning resources, educational demonstrations, online content, training activities and other learning support, subject to availability and the Foundation’s applicable policies.
This Disclaimer applies to the relevant programme, website pages, digital resources and related activities operated or provided by the Foundation, unless a separate written agreement or specific programme policy expressly provides otherwise.
02Nature of Free Educational Services
The initiative is intended to support educational access and public benefit. The term “free” means that no fee is charged for the particular learning activity or resource identified as free. It does not necessarily mean that devices, internet connectivity, travel, printed materials, third-party applications, examinations, certificates or other incidental expenses will be provided without charge.
Programme availability, eligibility, delivery methods, learning materials and participation arrangements may vary according to resources, operational capacity, technical requirements and programme-specific conditions. The Foundation does not guarantee uninterrupted access, a particular duration of service or permanent availability of any resource.
03No Guarantee of Learning Outcomes
Educational resources are provided for learning, awareness and skill development purposes. Although the Foundation endeavours to provide useful and appropriate educational content, it does not warrant or guarantee any particular academic result, examination score, certification, employment, admission, professional qualification, technical proficiency or other individual outcome.
Learning outcomes may depend on a participant’s age, prior knowledge, attendance, practice, access to suitable devices, internet connectivity, individual learning needs and other circumstances beyond the Foundation’s reasonable control.
04Children, Parents and Guardians
Where the programme serves children, including Nursery to Primary learners, their participation must be managed in accordance with applicable law and the Foundation’s child-safety procedures. Parents, legal guardians or duly authorised representatives are responsible for providing any consent legally required for participation, data processing, online accounts, photography, recordings or other activities.
Parents and guardians should provide age-appropriate supervision when children use digital devices, websites, online platforms or third-party applications. They should help children follow safe internet practices and avoid sharing personal information with unknown individuals.
The Foundation does not intend this Disclaimer to replace any safeguarding obligation, legally required parental consent or duty of care imposed by applicable law.
05Technology and Internet Risks
Digital learning may depend on electricity, internet connectivity, software, hardware, external platforms and telecommunications services. The Foundation shall not be responsible for interruptions caused by outages, network failures, device incompatibility, maintenance, cyber incidents or failures of third-party services, except to the extent that liability cannot lawfully be excluded.
Users are responsible for using suitable devices, maintaining reasonable device security and following the applicable terms of external platforms. No digital system can be guaranteed to be completely secure, continuously available or free from technical errors.
06Accuracy and Educational Content
The Foundation endeavours to review educational content with reasonable care. However, information may become outdated, incomplete or unsuitable for a particular learner or purpose. Content may be revised, corrected, withdrawn or replaced without prior notice where appropriate.
Educational material is provided for general learning purposes and should not be treated as individualised legal, medical, financial, psychological or other professional advice. Users should consult a suitably qualified professional where circumstances require it.
07Acceptable Use and User Conduct
Participants and visitors must use the Foundation’s educational resources lawfully, responsibly and respectfully. Users must not:
- Use the programme or website for unlawful, fraudulent, abusive or harmful activities.
- Attempt unauthorised access to systems, accounts, databases or restricted information.
- Upload malicious code, disrupt services or interfere with other participants’ learning.
- Harass, threaten, discriminate against or exploit another participant.
- Copy, distribute, sell or commercially exploit protected content without permission or another lawful basis.
- Misrepresent their identity, eligibility, qualifications or authority to act on behalf of another person.
Subject to applicable law and any contractual or statutory rights, the Foundation may investigate reported misuse and restrict or suspend access where reasonably necessary to protect participants, systems, educational resources or the integrity of the programme.
08Intellectual Property Rights
Unless expressly stated otherwise, the website design, original educational materials, text, graphics, logos, programme documents and other content created or lawfully owned by the Foundation are protected by applicable intellectual property laws.
Users may access and use such materials for their personal, non-commercial educational purposes, subject to the applicable licence, attribution requirements and programme conditions. Reproduction, republication, commercial distribution, modification or public dissemination beyond permitted use requires prior written permission from the relevant rights holder, unless otherwise permitted by law.
Third-party names, trademarks, software and learning resources remain the property of their respective owners and are subject to their own terms and licences.
09Privacy and Personal Information
Any personal information collected in connection with the programme shall be handled in accordance with the Foundation’s applicable Privacy Policy and relevant Indian data-protection laws. The Foundation should collect only information reasonably necessary for stated and lawful purposes and apply appropriate safeguards consistent with its legal obligations.
Users should not submit unnecessary sensitive personal information through public forms, comments or communications. Information relating to children must be handled in accordance with applicable legal requirements, including any requirements relating to verifiable parental consent, where applicable.
Please review the Foundation’s Privacy Policy for further information about data collection, use, retention, sharing, security and applicable user rights.
10Third-Party Websites and Services
The programme or website may refer users to external websites, applications, video platforms, educational tools or other third-party services. Such services may be governed by separate terms, privacy notices and security practices.
Unless expressly stated otherwise, the Foundation does not own or control independent third-party services and does not guarantee their availability, accuracy, security or suitability. Inclusion of a link or resource does not necessarily constitute an endorsement. Users should review the applicable third-party terms before using those services.
11Limitation of Liability
To the maximum extent permitted by applicable law, the Foundation shall not be liable for loss or damage arising from a user’s improper use of educational resources, failure to follow programme instructions, reliance on information without appropriate verification, or interruptions caused by circumstances beyond the Foundation’s reasonable control.
Nothing in this Disclaimer excludes, restricts or limits any liability, remedy or legal right that cannot lawfully be excluded, restricted or limited under applicable law. In particular, this Disclaimer does not remove any non-waivable statutory rights or override legal obligations relating to child protection, privacy, negligence, fraud or other matters where exclusion is prohibited.
Where permitted by law, any liability of the Foundation shall be assessed in light of the relevant facts, the nature of the service, the applicable agreement and the limits imposed by law.
12Indemnity and Unlawful Conduct
To the extent permitted by applicable law, a user may be responsible for losses, claims or reasonable costs directly resulting from that user’s unlawful conduct, infringement of third-party rights, deliberate misuse of the programme or material breach of applicable programme terms.
This provision does not impose liability on a child or any other person where such liability would be unlawful, and it does not relieve the Foundation of its own non-excludable legal obligations. Any claim will remain subject to applicable law and the facts of the individual case.
13Programme Changes or Suspension
The Foundation may modify, postpone, suspend or discontinue a particular class, resource, feature or programme where reasonably required by educational priorities, safety considerations, technical limitations, funding, staffing, operational needs or applicable law.
Where reasonably practicable, the Foundation may provide notice of material changes to registered participants. Nothing in this section authorises the Foundation to disregard an existing contractual obligation or a requirement imposed by law.
14Donations and Financial Contributions
If donations or voluntary contributions are invited in support of educational activities, such contributions are subject to the relevant donation terms, payment-provider conditions and applicable law. A donation does not automatically create a right to admission, a certificate, a particular service or any other benefit unless expressly stated in the applicable programme terms.
Donors should verify the Foundation’s identity and the details displayed on the official donation page before making a payment. Any tax benefit, receipt or exemption is subject to applicable law and the Foundation’s actual legal eligibility; no tax deduction should be assumed unless expressly confirmed by the Foundation and supported by applicable documentation.
15Governing Law and Legal Compliance
This Disclaimer shall be interpreted in accordance with the laws of India, subject to applicable statutory provisions and jurisdictional requirements. Any dispute shall be handled by a court or other competent forum having jurisdiction under applicable law.
If any provision of this Disclaimer is found invalid or unenforceable by a competent authority, the remaining provisions shall continue to apply to the extent legally permissible. A failure to enforce a provision on one occasion shall not automatically constitute a waiver of the right to enforce it later.
16Updates to This Disclaimer
The Foundation may update this Disclaimer to reflect changes in its programmes, technology, operational practices or applicable law. The revised version will be published on the relevant website page with an updated revision date. Users are encouraged to review the Disclaimer periodically.
This Disclaimer is intended to communicate programme conditions and legal limitations. It should be read together with the Foundation’s applicable Terms and Conditions, Privacy Policy and child-safeguarding procedures.
